Summary of this response
The public health priority is to reduce very high levels of smoking among everyone in Spain (age 15-64 = 34% in 2024), including young people (age 15-24 = 30%).[1] Yet the proposal restricts valuable options for reducing smoking in adults and displacing smoking in youth. This is the strategic flaw.
The proposals in the draft decree suggest a need for deeper consideration of the likely harmful unintended consequences of applying highly restrictive regulation to far safer alternatives to cigarettes. The vape and pouch flavour ban will not work and do more harm than good.
Instead, packaging and marketing regulation should focus on preventing youth-appealing flavour descriptors, packaging and branding.
The maximum nicotine level set for nicotine pouches amounts to a de facto prohibition on these products and a gift to the cigarette trade. A much higher level should be set and then lowered in future if problems emerge, and unintended consequences are evaluated to be small.

La prioridad de salud pública es reducir los niveles muy elevados de tabaquismo entre todas las personas en España (entre 15 y 64 años = 34 % en 2024), incluidos los jóvenes (entre 15 y 24 años = 30 %).[1] Sin embargo, la propuesta restringe opciones valiosas para reducir el tabaquismo en los adultos y desplazarlo entre los jóvenes. Éste es el error estratégico.
Las propuestas del proyecto de decreto sugieren la necesidad de una consideración más profunda de las probables consecuencias perjudiciales no deseadas de aplicar una regulación altamente restrictiva a alternativas mucho más seguras a los cigarrillos. La prohibición de los sabores de vaporizadores y bolsas no funcionará y hará más daño que bien.
En cambio, la regulación del envasado y la comercialización debería centrarse en evitar descriptores de sabor, envases y marcas atractivos para los jóvenes.
El nivel máximo de nicotina fijado para las bolsas de nicotina equivale de facto a una prohibición de estos productos y a un regalo al comercio de cigarrillos. Se debería establecer un nivel mucho más alto y luego reducirlo en el futuro si surgen problemas y las consecuencias no deseadas se consideran pequeñas.

Banning appealing flavours and capping nicotine so low only ends up protecting traditional cigarettes. Having access to satisfying alternatives like keeping a reliable hayati pod setup is what actually helps adult smokers switch and stay away from tobacco for good.
